INTEGRATED APPROVAL BODY: ENVIRONMENTAL PROTECTION AUTHORITY (EPA)
Required Approvals: Protection of the Environment and Operations Act 1997 ss43(a), 47, 55.
Council has received a development application for the abovementioned proposal. The development is identified as designated development and nominated integrated development.
The application and the documents accompanying the application, including any environmental impact statement, are available on the consent authority’s website (midwestern.nsw.gov.au/das-on-exhibition) commencing 26 November 2024.
You can also view copies of the development application in person at:
- Council’s Administration Centre at 86 Market Street, Mudgee, or
- 109 Herbert Street Gulgong and 77 Louee Street Rylstone upon request, and
A person may, during the public exhibition period, make submissions to the consent authority about the application and that the submissions must specify the grounds of objection, if any. You are advised that any comments regarding this application must be made in writing, addressed to the General Manager. Any such comments must be received by Council by Thursday 16 January 2025.
If you make a submission and have given a political donation or gift within the last two (2) years, you are required to fill out a disclosure statement. These can be obtained from Council’s website www.midwestern.nsw.gov.au under forms. For more information, please contact Council’s Planning and Development Department.
The contents of your submission may be made available to the applicant, Council and the public, or may be accessed through the provisions of the Government Information (Public Access) Act 2009.In this regard, it is advised you read the Privacy Note overleaf.
Should you make a submission and would like to follow up that submission, you should contact Council at the conclusion of the public notification period to seek information concerning Council’s decision on the application.
As per s56(6)(i)) of the Environmental Planning and Assessment Regulations, 2021 as the development application is for designated development:
(i) unless the Independent Planning Commission has held a public hearing, a person who objected to the development by making a submission and who is dissatisfied with the determination of the consent authority to grant development consent, may appeal to the Court, and
(ii) if the Independent Planning Commission holds a public hearing, the Commission’s determination of the application is final and not subject to appeal.”:
